A settlement of €65,000 has been approved for a teenage boy by the High Court after hot tea spilled on his leg while on board an airplane flight.
Burns to Right Thigh
The teenager, who was aged 13 at the time of the incident, had been travelling from Dublin to Istanbul in July 2017. The complainant claimed he had been scalded by hot tea when it was knocked out of his hand due to a mishap by a member of the cabin crew, causing him to suffer burns to his right thigh.

An affidavit provided by the boy’s mother detailed how the complainant had eventually attended a consultant plastic and reconstructive surgeon, who advised that the teenager had sustained scald injuries to his thigh. The surgeon further noted that while the wound had healed with dressings alone after a period of roughly three weeks, the complainant had been left with permanent and noticeable scarring at the affected area.
Significant Scar
Counsel for the complainant told Mr Justice Garrett Simons that the €65,000 settlement offered by the defence was reasonable and asked the court to approve it. Noting that although the boy had suffered a nasty burn which had fortunately healed, he was still left with a significant scar.
Mr Justice Simons further noted that the boy was unlikely to get a higher amount if the case were to go to trial due to the potential impact of the new guidelines on personal injury awards.
